Resumo

O artigo aborda a linguagem dos direitos humanos a partir do fenômeno das exigências por direitos. Para analisar esse fenômeno, pretende-se abordar a definição dos direitos a partir da correlação lógico-normativa entre direitos e deveres. Será que a tese da correlatividade pode explicar a natureza de todos os direitos humanos? Se seguirmos a lógica da dogmática jurídica, a resposta será positiva – ao menos essa é a pretensão normativa dos programas lógicos de fundamentação dos direitos. Porém, se observarmos os usos linguísticos que as pessoas fazem dos “direitos humanos” no mundo contemporâneo, verificar-se-á casos em que esses direitos são reivindicados mesmo quando não há um dever correlato. A partir do método analítico-descritivo, pretende-se mostrar que a pragmática dos direitos humanos desafia os projetos de justificação lógica dos direitos e instiga a investigação a abordar os diversos usos que as pessoas fazem da expressão “direitos humanos” seja no contexto de especialistas (como juristas, diplomatas, legisladores e governantes), seja no contexto de manifestantes e ativistas que enunciam suas reivindicações no cenário internacional. Ao final, pretende-se concluir que esses direitos adquirem sentido retórico e são reivindicados “contra o mundo” a partir de uma perspectiva mais genericamente moral do que estritamente jurídica.

Professor da Escola de Direito da Universidade do Vale do Rio dos Sinos - Unisinos. Professor Pesquisador do Programa de Pós-Graduação em Direito da Unisinos. Professor dos Cursos de Graduação em Direito e Relações Internacionais da Unisinos. Foi Coordenador do Curso de Graduação em Direito da Unisinos entre 2010 e 2022. Integra o Núcleo Docente Estruturante (NDE) do Curso de Direito da Unisinos. Doutor em Filosofia (2013); Mestre em Filosofia (2009); Licenciado e Bacharel em Filosofia (2007); Bacharel em Direito (2007) pela Unisinos. Tem experiência nas áreas de Filosofia e Direito, centrando-se na relação entre Moral, Política e Direito. Pesquisa, principalmente, os seguintes temas: Hume, Empirismo; Kant; Hobbes, Contratualismo; Kelsen, Positivismo Jurídico; Direitos Humanos, Direitos Naturais, Direitos Morais, Fundamentação.
