Soberania, cibersegurança e proteção de dados rumo ao “Efeito Pequim”

Resumo

O presente artigo analisa a estrutura da governança de dados da República Popular da China, com ênfase em sua formulação estratégica, arranjo institucional e arcabouço regulatório.  Busca-se compreender o modelo de governança e regulação com “características chinesas” voltado a garantir, de maneira integrada, a proteção de dados, a cibersegurança, e soberania digital, e a inovação tecnológica, por meio de uma abordagem que alavanca de maneira integrada estratégia, legislação e política industrial. A análise é realizada a partir de quatro eixos: os fundamentos históricos e culturais que moldam a visão estatal sobre dados; os mecanismos de experimentação normativa utilizados para validar políticas públicas antes de sua implementação regional ou nacional; os instrumentos institucionais e regulatórios que sustentam o modelo; e os impactos internacionais da estratégia, considerando o contexto da Rota da Seda Digital. Conclui-se que o modelo chinês representa uma abordagem sistêmica, centrada na busca pela eficiência, segurança nacional e o desenvolvimento tecnológico, em contraste com os paradigmas supostamente centrados na proteção individual típicos das democracias liberais.
