A reação do Direito à transformação digital

Resumo

Este artigo examina as consequências da transformação digital no campo da legislação e da aplicação da lei. Os desafios para o sistema jurídico estão particularmente associados à natureza aberta dos desenvolvimentos futuros e, ao mesmo tempo, à convergência e à indefinição de fronteiras. Há também uma expansão de novas constelações de poder, juntamente com o aumento dos problemas de controle. Novos desenvolvimentos, como o triunfo da inteligência artificial (IA), especialmente a IA generativa, precisam ser enfrentados. As dificuldades são claramente ilustradas pela Lei da IA, adotada pela União Europeia. A legislação e a aplicação da lei, incluindo a jurisprudência, precisam se tornar mais interdisciplinares e transnacionais em sua orientação.

ABSTRACT: This article examines the consequences of digital transformation in the field of lawmaking and law enforcement. Challenges for the legal system are particularly associated with the open-ended nature of future developments and, at the same time, with convergence and the blurring of boundaries. There is also an expansion of new power constellations, coupled with increased control problems. New developments, such as the triumph of artificial intelligence (AI), especially generative AI, need to be addressed. The difficulties are clearly illustrated by the AI Act adopted by the European Union. Legislation and law enforcement are required, including jurisprudence, to become more interdisciplinary and transnational in their orientation.
